Overview of RERA Andaman and Nicobar Island
All the real estate projects and other matters related to Andaman and Nicobar Island are monitored by the TNRERA. It covered all the current and future projects. Any negligence or failure to register with the RERA will be a punishable offence. As a result, the agent or the promoter will have to pay the penalty or get imprisonment.
Benefits of RERA Registration
Registration of projects and agents with the Real Estate Regulatory brings in a lot of benefits as described below:
- Standardisation: Generally, real estate agents have their own definition of carpet area. But with the introduction of RERA, the definition of carpet area has been revised and set, and every agent and broker has to abide by the same.
According to RERA, the net carpet area is referred to as the:
“The net usable floor area of an apartment, except the area enclosed by the exclusive balcony or verandah area, external walls, areas under services shafts, and exclusive open terrace area, but comprises the area enclosed by the internal partition walls of the apartment.”
- Advance Payments: No builders can take more than 10% of the cost of flats, apartments, etc., before getting into any kind of agreement with the home buyer.
- Increase in Investments: The act offers security to home buyers and ensures that projects are delivered within a stipulated period of time. This has gained the trust of people, and as a result, people are investing more in real estate without any fear of losing their money.
- Transparency: This is one of the major advantages of all that a buyer can have. They get access to information about the project plan layout, its execution, construction, competition status, and more.
- Timely Delivery of Projects: The act is quite stringent about the timely delivery of projects. However, in any case, the builder fails to render the project within the time promised, he would be entitled to some kind of penalty, and the buyers will get compensation over the same.
- Grievance Redressal within 60 days: Any grievance against the builder can be made to the state authority known as the Appellate Tribunal. The tribunal will look into the matter and address it within 60 days of the complaint being filed.

Documents Required for Registering under RERA Andaman and Nicobar
The documents required for RERA registration might differ for different entities. However, we have compiled a list of all the documents that one will need to submit while registering:

How can Promoters Register a Project under TNRERA?
Here are steps promoters can follow to register the project as an individual or a company:
Step 1: Go to the official website of Andaman RERA.
Step 2: Under the ‘Online Registration for Projects’ option present at the top right corner of the page, click on the ‘Andaman’ tab.
Step 3: It will take you to the new webpage called ‘Application for Registration of Projects by the Promoter.’
Step 4: Read the info provided on the page carefully and keep all the scanned documents ready (documents to be submitted are already described in the previous section).
Step 5: Now, click on the ‘Proceed’ option that is present at the bottom of the page.
Step 6: You will now be directed to another webpage called the ‘Real Estate Registration.’ You have to choose from whether you want to register the project as an individual or a Society/Company/Partnership, etc. Now enter your Email ID or registration number.
Step 7: Once you are done with entering all the details, click on ‘Next,’ and you will be redirected to a new web page containing Form “A”.
Step 8: Enter the information asked in the form, such as promoter details, previous project details, financial indicators, and upload your passport-sized photograph. Once you are done, click on the “Next” option.
Step 9: After entering project details, upload the scanned documents. Next, you will be directed to the payment gateway option.
Step 10: Once your payment has been confirmed, you will receive a registration number for the project registered.
Timeline For RERA Registration
According to the provisions of the act, the RERA department will issue the certificate within 30 days. Nevertheless, it may arrive earlier.

Step 1: Go to the official portal of TNRERA (Tamil Nadu Real Estate Regulatory Authority).
Step 2: Take the cursor to the ‘Registration’ section in the navigation bar. Then, hover over to the ‘Projects’ option.
Step 3: In the Projects section, click on the ‘Registered Projects’ tab.
Step 4: Click on the ‘Andaman’ tab in the Registered Projects section.
Step 5: You will be directed to a new page where you will be provided with the list of all the registered projects under Andaman and Nicobar Island RERA.

Just like the above section, follow a few similar steps to check registered agents on RERA Andaman and Nicobar Island website:
Step 1: Visit the official website of RERA Tamil Nadu.
Step 2: Go to the ‘Registration’ section and click on the ‘Agents’ tab.
Step 3: The Agents tab will show you three options- a) Apply Online, b) Registered Agents (Offline), and c) Registered Agents (Online). Choose from the options suitable for you. You can go for either registered agents online or offline.
Step 4: Whatever option you choose, you will be introduced to two more options. You have to click on the ‘Andaman’ option.
Step 5: You will be directed to a new page containing the list of all the Registered Agents with RERA Andaman and Nicobar.
Step 6: If you wish to search for a particular agent, you can simply write the name of the agent in the search section. If the agent is registered, the page will return to the search option.
How to File a Complaint with RERA Andaman and Nicobar?
Follow the steps below to register your complaint with the RERA Andaman and Nicobar:
Step 1: Go to the official website of TNRERA.
Step 2: Click on the ‘Downloads & Links’ option. Click on the ‘Download’ tab from the dropdown.
Step 3: The Download section will further present two options- Project Registration and Complaint Registration. Click on the ‘Complaint Registration’ tab. This will further show you three more options.
Step 4: Click on the Form ‘M’- Complaint to Regulatory Authority.
Step 5: Fill out the form and submit an online fee of ₹ 1000.
Step 6: Attach at least three copies of all the supporting documents.
Step 7: Send the form along with the supporting documents to the registered authority by post. Or you can also visit your nearby office and submit it yourself.

Step 8: Also, the complainant had to pay an additional sum of ₹ 600 to the authority as postal charges.
Appellate Tribunal
Every RERA has a statutory framework constituted under the State RERA Act, which is called the Appellate Tribunal. The prime objective of this body is to hear appeals against the orders of the authorities and the adjudicating authority.
Anybody registered under Andaman and Nicobar RERA seeking to appeal may do so with the TNRERA Appellate Tribunal.
Under the TNRERA Act, any person affronted by any decision or direction or orders made by the adjudicating officer or the authority may choose to appeal before the Appellate Tribunal holding jurisdiction over the issue.
All the appeals under sub-section (1) of Section 44 of the Act must be followed by a fee of ₹ 1,000. Moreover, the appeal must be filed in Form ‘L’ along with the following documents:
- a) An attested true copy of the order against which appeal is filed.
- b) An Index of the documents
- c) Copies of documents trusted upon by the appellate and referred to in the appeal.

Does Andaman RERA lie under Tamil Nadu RERA?
Yes, the Tamil Nadu RERA has jurisdiction and oversees every real estate project in Andaman and Nicobar Island. In fact, it is governed under the TNRERA Act.
Does the RERA Act apply in Andaman and Nicobar?
Yes, the RERA Act was introduced in Andaman and Nicobar Island in 2017. Therefore, the act has been applicable there since May 2017.
Who all are eligible to register themselves under the RERA Andaman?
According to Andaman RERA, all the ongoing projects, real estate agents, and promoters must obtain RERA registration under the RERA authority. This should be done so as to take up a construction project with over 500 square metres of a proposed land area or a building consisting of more than eight apartments.
Can a promoter advertise the project without having a RERA Registration number?
No, a promoter can’t advertise his/her project unless he/she is registered with RERA. As per Section 3 (1) of the Act, the promoters can advertise their project for sale only after their real estate projects are registered with the Real Estate Regulatory Authority.
Is it obligatory for promoters to get their accounts audited?
Yes, the provisions of Section 4 (2)(1)(D) state that the promoters have to mandatorily get their account audited within the completion of six months at the end of every fiscal year. Moreover, the chartered accountant must offer a certified statement of the promoter’s account after examining the fact that the amounts collected for that particular project haven’t been used for any other purpose than the construction of the project.
