Cybage Software Faces Legal Action for Violating Environmental Regulations

Maharashtra Pollution Control Board Issues Show-cause Notice to IT Firm for Environmental Violations

The Maharashtra Pollution Control Board (MPCB) has taken action against Cybage Software, an IT firm, for violating environmental regulations during the construction of its new building in Kalyaninagar. The firm has been issued a show-cause notice by the MPCB, requiring it to respond within seven days or face further consequences.

Violation of Permissible Noise Limits and Improper Water Discharge

According to the notice issued by the MPCB, Cybage Software had exceeded the permissible noise limits during the construction of its new tower. This violation has led to complaints from residents of the Kumar Kruti housing society, who have been disturbed by the excessive noise. Additionally, the pollution board found that water was being discharged into a nearby nullah during excavation work, creating potential environmental hazards.

Potential Consequences and Repercussions

If Cybage Software fails to respond to the show-cause notice within the given timeframe, the MPCB indicated that it would take further action against the project. The notice also suggested the possibility of forfeiting the company’s existing bank guarantee and initiating legal proceedings.

Company’s Response and Legal Clearance

In response to the notice, a spokesperson for Cybage Software mentioned that the company had obtained all necessary legal clearances for the construction work. However, they declined to provide further comments on the matter.

Concerns Raised by Residents and Inspection by MPCB

Residents of the Kumar Kruti housing society expressed their concerns about excessive noise and dust emissions from the construction site. The noise pollution has become particularly unbearable for the residents, impacting their daily lives. Some residents even mentioned considering a temporary relocation until the construction work is completed.

Following the complaints, on August 12 and October 10, MPCB officials inspected the site to assess compliance with environmental regulations. The findings indicated that Cybage Software had been carrying out blasting activities without renewing its no-objection certificate, which had expired on August 24. The noise levels at the site were reported to have exceeded the allowed limit of 80-90 decibels. Moreover, the firm had neglected to implement sound absorption measures during digging, and blasting was being done without proper permissions.

Structural Damages Caused by Construction Activities

Munir Vastani, a former secretary of the Kumar Kruti housing society, pointed out that the ongoing construction work had caused damages to the society’s clubhouse and one of the building’s pillars. The cracks appeared as a result of the construction activities carried out by Cybage Software.

Call for Accountability and Environmental Compliance

This incident underscores the importance of ethical construction practices and compliance with environmental regulations. The show-cause notice issued to Cybage Software by the MPCB aims to hold the firm accountable for its violations and ensure that appropriate measures are taken to rectify the environmental damages caused.

Moving forward, it is imperative that companies, especially in the IT sector, prioritize environmental sustainability during their construction endeavors. Adhering to noise regulations, managing water discharge responsibly, and seeking proper permissions and certificates should be top priorities to avoid legal consequences and potential harm to the environment and nearby communities.
