Delhi Court Directs Fresh Probe in Cheating Case Involving Gautam Gambhir and Real Estate Firms
Delhi court has set aside the discharge of former cricketer and current head coach of the Indian cricket team, Gautam Gambhir, and directed a fresh investigation in a cheating case. The case involves real estate firms Rudra Buildwell Realty Pvt. Ltd, H R Infracity Pvt Ltd., U M Architectures and Contractors Ltd., and Gambhir, who was a director and brand ambassador of the companies’ joint venture. Judge Gogne, in his order on October 29, stated that “the allegations also merit further investigation into the role of Gautam Gambhir.”
Allegations Against Gautam Gambhir
The case of alleged cheating was filed against the mentioned real estate firms, and Gautam Gambhir, who had a “direct interface with the investors” as a brand ambassador. The court observed that the magistrate court’s order did not mention Gambhir paying Rs 6 crore to Rudra Buildwell Realty Pvt. Ltd and receiving Rs 4.85 crore from the company. The core issue here pertains to whether or not Gambhir had any involvement with the funds received from the investors in the project. The court also highlighted that Gambhir had additional financial transactions with the company beyond his role as a brand ambassador, and was an additional director during the project’s advertisement period.
Court’s Order and Remand
The court set aside the discharge of all accused and remanded the case back to the magisterial court. The magisterial court has been directed to pass a detailed fresh order on the charge, specifying the allegations against each accused and providing corresponding evidence from the chargesheet. This will help establish the clarity of each accused’s involvement in the case of alleged cheating.
About the Alleged Cheating Case
The accused, including Gautam Gambhir, Rudra Buildwell Realty Pvt. Ltd, H R Infracity Pvt Ltd., U M Architectures and Contractors Ltd., supposedly promoted and advertised a housing project called “Serra Bella”, which was later renamed to “Pavo Real”. The complainants alleged that they booked flats in the projects and made payments based on the enticing advertisements and brochures. However, there was no significant progress in terms of development on the plot, even after the payments were made. It was later revealed that the proposed project was not developed as per the site plan and had not been approved by the necessary government authorities.
Conclusion
The Delhi court’s decision to order a fresh investigation in the cheating case involving Gautam Gambhir and real estate firms reflects the need for a thorough examination of the allegations. This step will help determine the extent of each accused’s involvement in the case and deliver justice to the affected flat buyers. The court has sought to ensure that all relevant evidence is considered and an informed decision is made in accordance with the law.
