Delhi’s Green View Society Project Stays Standing As Demolition Request Denied

The district administration of Delhi has denied permission to the National Buildings Construction Corporation (NBCC) for the demolition of its Green View Society project in Sector 37D. This decision comes after the condominium was declared unsafe based on structural audits conducted by IIT-Roorkee and Central Building Research Institute (CBRI).

Residents Object and Seek Compensation

The developer had approached the district administration on June 25 with a request to bring down seven towers in the Green View Society. However, this proposal was met with opposition by flat owners belonging to the Economically Weaker Section (EWS). These flat owners raised concerns over the non-settlement of compensation and decided to file a case at the Delhi High Court.

Residents were given an instruction to vacate their flats by the end of March 2022. The district administration’s denial of permission for demolition follows protests by EWS allottees as well as the pending case in the Delhi High Court regarding non-settlement.

Compensation Issue Still Pending

During a Samadhan camp organized by the administration, EWS flat owners expressed their grievance regarding the delay in compensations. They highlighted that no final decision had been taken regarding their claims and also mentioned the ongoing hearing in the high court.

The District Town Planning Enforcement (DTPE), in communication with NBCC, has stated that it must follow the final high court order once it is issued. Additionally, they have requested the deputy commissioner to provide guidelines to the district revenue officer for registering the flats of EWS allottees, thus facilitating their claims with NBCC.

Approval and Compliance

According to the recent letter sent by NBCC to DC Nishant Yadav on June 25, the developer emphasized the grave dangers posed to residents due to structural problems. The letter cited the February 17, 2022 order by the district magistrate and the head of District Disaster Management Authority, who raised concerns over threats to life and property.

In alignment with the ongoing proceedings, NBCC must now obtain permission from the Delhi High Court and comply with their orders.

Efforts for Compensation and Rent

Back in March, the developer had initiated the process of providing compensation and rent to flat owners following an order by the National Consumer Disputes Redressal Commission. Flat owners who opted for reconstruction were offered rent at the rate of Rs 15 per square foot, while those who preferred compensation were offered the total amount paid to the company at a 9% interest rate. In addition, an exemplary damage payment of Rs 10 lakh was also offered.

Despite these offers, the allottees were not willing to accept them, leading to the continuation of the compensation issue.

The fate of the Green View Society project continues to hang in balance as the district administration denies permission for demolition and residents await resolution regarding their compensation claims.
