Gurugram Residents Protest Demolition of NBCC Green View Society Towers

Gurugram administration denies permission to demolish NBCC Green View

The district administration in Gurugram has denied permission to the National Buildings Construction Corporation (NBCC) to demolish its Green View Society project in Sector 37D. This decision was made following protests by flat owners belonging to the Economically Weaker Section (EWS) and an ongoing case in the Delhi High Court regarding non-settlement of compensation.

Structural audits conducted by IIT-Roorkee and Central Building Research Institute (CBRI) had declared the Green View Society project unsafe, prompting the developer to seek permission for demolition. However, EWS flat owners objected to the proposal and approached the Delhi High Court for compensation.

During a Samadhan camp conducted by the administration, EWS flat owners expressed their concerns about the lack of a final decision on their compensation claims and highlighted the ongoing hearing in the High Court. The District Town Planning Enforcement (DTPE) has informed NBCC that they must follow the final order of the High Court. Additionally, the DTPE has requested the Deputy Commissioner to provide guidelines to the District Revenue Officer for registering the flats of EWS allottees and facilitating their claims with NBCC.

Now, NBCC is required to obtain permission from the High Court and comply with their orders. Deputy Commissioner Nishant Yadav stated that they received requests from residents to halt the demolition as the matter is pending in court, and they have directed NBCC to bring their request before the court at this time.

Flat owners in the Green View Society project had been offered compensation and rent by the developer earlier this year after an order by the National Consumer Disputes Redressal Commission. However, the allottees were not ready to accept the offer.

This decision by the Gurugram administration showcases the importance of considering the concerns of residents and ensuring any demolition plans align with the legal proceedings. The ongoing case in the Delhi High Court highlights the need for a fair resolution for the EWS flat owners.

Conclusion

The denial of permission to demolish NBCC Green View Society by the Gurugram administration demonstrates the importance of addressing the concerns of residents, especially those belonging to the Economically Weaker Section. The ongoing case in the Delhi High Court will provide clarity on the compensation claims of the flat owners. It is crucial for developers and authorities to follow legal procedures and ensure a fair resolution for all parties involved.
