In Himachal Pradesh, RERA Act was passed on 28 September 2017 while the RERA rules were notified in February 2017. The state appointed the director of the town and country planning as the designated officer. 

RERA in Himachal Pradesh applies to both ongoing and upcoming projects in the state. After the launch of the authority in the state, the real estate industry has witnessed a transparent and efficient sale of plots, apartments and buildings.

RERA Himachal Pradesh Registration Process Fees

RERA Himachal Pradesh Registration Process Fees is as follows:

  • Registration made by Agent – INR 5000 for individuals & INR 20,000 for others.
  • Renewal Registration – INR 2,500 for individuals & INR 10,000 for others.
  • Complaint filing – INR 500.

Registration Process – RERA Project

The process of RERA Registration is quite lengthy and takes up a lot of time but we have made the process seem a little easier for you. There are a total of 7 pages that need to be filled in and uploaded to the official portal along with 10 documents. 

Mentioned below is the stepwise guide about the process of real estate project registration in a simple and precise manner.   

Step 1: You will have to visit the HP RERA official website. 

Step 2: If you are a first-timer then you will have to first get your name registered as a “Promoter”. You need to select “Promoter” under the Register option. 

Step 3: Next, you need to enter the details along with the necessary documents. Select “Save” to create the profile. Now you can move to the project registration.

Step 4: Go to the home page and choose the “Registration” option. Then click on “Real Estate Project” and select “Apply New Project” as per the requirement. 

Step 5: A new webpage will open where you have to log in to your Promoter’s account. 

Step 6: There are seven pages that need to be filled:

  • Promoter’s profile- All personal details and other relevant financial details.
  • Details of the project- The important details of the project like location, ownership, and size are to be entered.
  • Sanctioned project- The sanctioned project details like the type of project, sanctioned plan, stability certificate of the structure, etc.
  • Project professionals- The name and certificates of the professionals involved in the project must be entered.
  • Civic facilities- The relevant facilities as per the project requirement need to be selected. 
  • Project Declaration- The verification of the relevant documents is to be done in Form B by Affidavit/Declaration. It is an important page as all the documents need to be verified before the form is submitted. 
  • Project fee- The project fee is dependent on the size of the area and type of project. The mode of payment is online.

Registration Process – RERA Agent

Agent Himachal Pradesh RERA website registration process is similar to HP RERA project registration. The only difference is that the agent registration process does not need the submission of many documents and is less time-consuming.

Step 1: You need to visit the HP RERA website.

Step 2: Choose “Register” and click on “Agent”. Then you will have to enter the basic details and log in to complete the process. 

Step 3: After logging in you can continue with the registration form. The two tabs that needed to be filled are Registration and fee. 

Step 4: Verification of the information is to be done after filling all the required boxes. After checking the entered information, select the “Final Submit” option to receive your Real Estate Certificate of Registration. 

Documents Required- RERA Project

The necessary documents and the registration form are required to be uploaded to the official portal of HP RERA. 

The financial documents required are:

  • Sale agreement, Allotment letter, Conveyance deed, possession letter
  • Details and certificates of Professionals involved in the project
  • Civic facilities
  • Structural stability certificate
  • Sanctioned project plan and location plan
  • Himachali Certificate of Agriculturist

The personal details required are:

  • Aadhar number and PAN
  • Annual financial report
  • Bank details
  • Passport size photos
  • Ownership document
  • Revenue documents like the non-encumbrances report, demarcation report, and Tatima

HP RERA Rules

The ultimate goal of introducing the Himachal Pradesh RERA was to bring transparency to the real estate sector by governing it. As per the rules, every real estate agent must get themselves registered with HP RERA while the promoters must get their ongoing as well as upcoming projects registered with the same. 

Also, the rule says that the real estate developers must share every project info with homebuyers investing in it. This will ensure the interests of homebuyers are protected as the government stays in sync between the customers and developers. 

Also, advertising projects that aren’t registered with RERA Himachal Pradesh would be counted as illegal ads. If any promoter is found doing so, strict legal actions would be taken against him. 

Moreover, there’s no provision for accepting any advance or deposits unless developers have an agreement with the buyers. 

RERA Himachal Pradesh is also accountable for resolving any complaints registered by the homebuyers under it. 

RERA Benefits – Homebuyers

Let us look at the benefits of the Real Estate Regulatory Authority in general. 

  • The detailed information about RERA registered Projects has to be disclosed by the builders on the official website and should be up-to-date.
  • Only the carpet area can be charged by the seller and not the super built-up area.
  • 70% of the collected money is to be used for the completion of construction work. Therefore, it promises timely completion.
  • 2% interest rate to be paid by the developer in case of any delay (that is above the Marginal cost of SBI’s lending rate).  
  • The builder will be held responsible for a total of 5 years in case of any defect in the construction.
  • Within 120 days, all the disputes must be sorted out with the builder.

Recently, Himachal Pradesh RERA was ranked the second best amongst all other RERAs in the country. The ranking of RERA Himachal Pradesh is based on the effectiveness of how well the authority executes its order by initiating execution proceedings within one and a half years of its launch. 

In a very short span of time, the RERA authority in the state registered about 52 real estate agents and 38 new real estate projects. 

Moreover, all the hearings of complaints take place digitally and the parties don’t need to visit the RERA office physically. This has especially made the whole process quite convenient for the stakeholders to follow their cases.
