Impact of Karnataka RERA on Real Estate Market

The establishment of the Karnataka Real Estate Regulatory Authority has helped clear the sectors of prevailing problems like lack of transparency. One effect it has had on the market is that it has forced developers to deliver on-hold projects, before embarking on new projects. Gradually, the market became more favorable to buyers owing to easier payment models, an increase in accountability for developers, and better credibility. As a testament to the effectiveness of the RERA act, it has to be noted that Bangalore has become one of the most active residential markets over the last 2 years.

Impact of RERA on Property Prices in Karnataka

Owing to the flurry of changes from 2016 to 2019(RERA, GST, and demonetization), some localities in Bangalore saw a rise in prices of property, increasing by an average of 11%. This can be attributed to the vast and rapid development of the city. In recent times, the city has attracted investment from various multinational companies and large organizations. This has led to an increase in footfall in the form of a large number of young working professionals.

Due to the strong demand of the customer base, Karnataka real estate was able to handle the uncertain times with little to no difficulty. Consistency in demand helped in maintaining the developer’s confidence, who abided by ‘ask’ rates in order to keep up with pressurized sales. Even though the developers went to great lengths to hide details regarding upcoming projects, they were inclined to offer huge discounts in order to finish off existing units. As a result of which, a significant change in property prices was not observed due to the establishment of the Karnataka RERA.

Impact of Karnataka RERA on New Launches

Post the implementation of demonetisation, the new real estate launches reported a massive slump, which in turn meant a dip in the supply of new projects. In addition to this, the establishment of RERA meant a drop of 23% in new launches. The new launches were affected for a short period of time, while developers got compliant with the new Karnataka RERA rules and regulations. The developers soon returned with RERA Karnataka registered projects on the city outskirts, in order to meet the growing housing needs.

The market trend indicated a preference for more affordable and mid-segment homes, as developers adapted in accordance with the new demand from the market. As a result, the majority of new launches in the resulting years have been affordable and mid-segment homes.

Future Challenges

One of the biggest problems of the implementation of Karnataka RERA is the slow registration of projects under the new rules of RERA. Further, there have been many challenges in the execution of orders as released by the Appellate Tribunal. Even though several provisions were set up for the imposition of penalties, registration cancellation, and confiscation of properties, they have failed to be strongly enforced. Further, the authority also faces a massive problem in the form of a shortage of staff. This means that the authority does not have enough manpower to deal with cases or inspect projects.

Benefits for Home Buyers Under Karnataka RERA

The following are some of the benefits that homebuyers enjoy owing to the establishment of the Karnataka Real Estate Regulatory Authority:

  • Homebuyers now have access to all the information that they did not have before. They can now use the RERA Karnataka website to look up information like true carpet area of the project, price of the project, number of units in the project, etc
  • The price of the property now depends on the carpet area of the project. Unlike like earlier times, the developers cannot now charge the buyers for the total built-up area
  • Since the developers now have to keep 70% amount in a separate bank account, the possibility of delay in the project due to lack of funds is drastically reduced
  • The developer is now required to make amends in case any defect is found within 5 years of possession
  • Any conflict between the buyer and developer now has to be resolved within 120 days
  • In the event of delay in delivering the project, then both the buyer and developer have to pay an interest of 2%
