Adverse possession is a legal term. This means that legal property ownership (of another person) may be acquired by an individual. For doing this, they have to swiftly acquire possession or reside on this property for a specific duration or period of time. The property form in this case is usually land.
Adverse possession means any legal guideline, under which the title of a property is granted to an individual residing on the same or already in possession of land belonging to another individual. The title of the property is given to this person or the possessor, upon adhering to specific terms and conditions, inclusive of whether there is any infringement on the owner’s rights and also whether they remain in continued possession of the property in question. This is sometimes known as the rights of squatters although the phrase may mean something different. Owners can also take steps to avoid any adverse possession.
Adverse possession applies in cases where properties were acquired by those residing in a property or possessing the same for twelve years. They got ownership rights to these properties as a result, if there was no legal interruption from the property owner. Adverse possession has also evolved into the concept of advance possession, where properties are subjected to hostile takeovers or acquisitions, with the legal owners not getting any claims to their properties. These also mean the rights of squatters in a colloquial sense, where they may acquire property ownership with continuous possession or occupation of a property. However, possession will not turn adverse, in case there is a legal tenancy/license from the property owner. Owners may recover property possession with several legal measures.
