Attractive nuisance means any condition on a property which is dangerous and hazardous for children, posing threats to their security.

Attractive nuisance is a provision under tort laws, where any individual building or allowing any such dangerous condition to exist on his/her land, which may be harmful to children (for example, a pool which is not fenced), will be liable for any injuries and mishaps, in spite of these children being trespassers.

Use of Attractive Nuisance in Real Estate

There is an attractive nuisance doctrine which is applicable in the real estate field. This talks about the landowner’s liabilities in case of any such dangerous condition existing on his/her property. This has been used for holding them responsible for issues like debris, sand piles, and so on. It applies to almost anything present on a property or land parcel.
