DOMINANT TENEMENT

A dominant tenement means possessing any easement over any land that belongs to another property. The land on which there is any attached easement is called the dominant tenement, while the land on which any servitude/burden is placed, is known as the servient tenement.

Use of Dominant Tenement in Real Estate

The dominant tenement concept is prevalent throughout the mainstream real estate sector. This is a land parcel which benefits greatly from any easement on the adjoining property or land parcel. For example, right to access a road or infrastructure like sewage/water lines in another property may constitute any such easement. This is why the concept has relevance in the real estate sector, and may cover various structures and buildings.
