ENCROACHMENT

Encroachment means stepping unlawfully onto someone’s land, property, time, or other aspects. It is an intrusion into someone’s legal rights, territory, and anything that surpasses acceptable restrictions. It may mean gradually intruding into something and hindering the rights of someone else.

Use of Encroachment in Real Estate

Encroachment is rampant in the real estate sector. There are often encroachers or squatters who have to be legally evicted from vacant plots, or land parcels. There are encroachers like neighboring property owners, who violate legal rights, through unlawful entry, extensions, or developments or constructions of structures onto the land of the neighbor without proper permission. This could be a fence that suddenly enters your property, any construction that encroaches into the same, usage of your land for other purposes by people who are not legally authorized to do the same, and so on. Encroachment may be intentional or unintentional. If it is not fixed, encroachment may lead to legal issues and disputes. It may also cause issues while trying to sell property.
