INTIMIDATION

Intimidation is basically the act of coercing, threatening, or even interfering with someone fundamental rights. In terms of real estate, it may be expressed in relation to the enjoyment of one properties. It should be noted that the Indian Penal Code provides for protection against such intimidation in the following ways:

It is illegal if done orally, in writing, or by usage of any other way. 

It is unlawful to intimidate a person engaged in the activity of spreading among people or making people aware of the rights granted by the IPC.

Again, it is illegal to retaliate or avenge against any person who complained, testified, provided assistance, or participated in any sort in the proceeding under the IPC.

Definition

Any sort of threat to injure a person, damage their reputation, or harm their property carrying the intention to make them do something unlawful is a configuration of not only intimidation but also criminal intimidation. For instance, grabbing a person legally purchased land by threatening or using force to which the member or party has no legal entitlement, is a form of intimidation. This is known as land grabbing which is an illegal ordeal. At times, this may not be done using force but may be done using fraudulent documents. Such activities may be done by individuals, or even by groups commonly or popularly known as land mafias.

Use of Intimidation in Real Estate

It should be recognized that there is no such accurate usage of intimidation when it comes to real estate. Therefore, the application of the term “intimidation” can be seen in the real estate industry in the following manners:

A person’s basic rights cannot be denied or even limited in terms of real estate-related transactions using any sort of logic.

It is absolutely lawless if intimidation is done due to someone race or origin, skin tone or complexion, religion or religious beliefs, sex or gender, physical disabilities, or familial status. It is absolutely illicit to take into consideration any of the aforementioned factors when concluding a real estate contract.

It is against the law to resort to intimidation of an employee or an agent by threatening them with dismissal on the grounds that they are assisting a person in a particular real estate venture due to the fact that the person in question belongs to a certain race, religion, gender, or has certain physical afflictions, skin color, etc.
